These Terms and Conditions (T&Cs) govern the relationship between Tatu City Limited as the promoter of this campaign and you as a Participant.
By accepting these T&Cs, you confirm that you have read, understood, and agree to them. Please indicate your acceptance by checking the ‘‘accept’’ box.
- This promotional campaign is being run by Tatu City Limited (the “Promoter”). To learn more about Tatu City, please visit: tatucity.com.
- To be eligible, you are required to sign the Offer Letter and make a ten percent (10%) deposit of the Purchase Price within fourteen (14) days and finalize the process by signing and returning the Sale Agreement in respect of a plot in Kijani Ridge within thirty (30) days.
- The promotion will run from 09:00 EAT on 18 April 2024 and close at 23:59 EAT on 30 April 2025.
- Participants who meet the requirements will receive a Shopping Voucher of Kenya Shillings Fifty Thousand (Kshs, 50,000/-) for every plot reserved in accordance with clause 2 above.
- All Shopping Vouchers must be collected by 31 May 2025 from Tatu House, off Ruiru-Kamiti Road.
- The Shopping Vouchers are not transferable and can only be claimed by the respective eligible Participants.
- The Shopping Vouchers are not redeemable for cash or other forms of credit;
- By taking part in this promotional campaign, you authorize the Promoter to publicly use your photograph and name for publicity purposes. As a recipient of the Shopping Voucher you unconditionally grant the Promoter the right to use your photograph or any form of your likeness for a period of two years after the award date for news, publicity, information, trade, advertising, public relations, and promotions, without any further compensation, notice review, or consent;
- By participating in this promotion, participants automatically sign up to the Tatu City newsletter;
- Any costs associated with accessing the promotional website remains the responsibility of the participant and are dependent on the Internet Service Provider used;
- The Promoter shall collect the participant’s personal information process participants’ personal information in accordance with the Data Protection Act, 2019 of Kenya. Such information will be used solely for the purposes of administering and executing the promotion. The Promoter shall not disclose any personal data to third parties except where required or permitted by law.
- The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the campaign;
- If any of these terms and conditions are found to be void or unenforceable, in any respect, such provision shall be deemed severed from these terms and conditions, and the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired, and shall continue in full force and effect;
- The Promoter shall not be held liable for any delay or failure to perform its obligations under this promotion where such delay or failure is caused by a Force Majeure event. Force Majeure shall include, but is not limited to, acts of God, fire, flood, pandemic, explosion, riot, war, hurricane, sabotage, terrorism, vandalism, accident, governmental restrictions or regulations, injunctions, labor strikes, or any other events beyond the reasonable control and anticipation of the Promoter;
- These terms and conditions shall be governed and construed in accordance with the laws of Kenya; and
- Any dispute arising out of or in connection with these terms and conditions shall be referred to and determined exclusively by a court of competent jurisdiction within the Republic of Kenya.
