Terms and Conditions
Please read these terms and conditions carefully and signify your acceptance by checking the ‘‘accept’’ box.
1. Campaign Overview
1.1 A Season To Own (hereinafter the “Campaign”) is organized and administered jointly by Tatu City Limited, Zuri Spring Properties Limited and Oaklands Properties Kenya Limited (hereinafter the “Promoters”).
1.2 The Campaign shall commence on 29 November 2025 and terminate on 20 December 2025.
1.3 All vouchers issued under this Campaign must be collected no later than 10 January 2026.
1.4 This Campaign is a promotional activity and does not constitute a lottery, betting, or gaming activity within the meaning of applicable law.
2. Eligibility
2.1 Participation is open exclusively to clients who satisfy the payment requirements set forth herein.
2.2 Eligibility is determined strictly on a “first come, first served” basis, subject to the numerical limits per project as detailed in Clause 3.
2.3 The Promoters reserve the right to verify compliance with these Terms prior to issuing any voucher.
3. Voucher Allocation
3.1 A voucher valued at KES 20,000 shall be awarded to each of the first thirty (30) clients who purchase land at Oaklands and who remit a ten percent (10%) deposit of the purchase price within five (5) days.
3.2 A voucher valued at KES 30,000 shall be awarded to each of the first thirty (30) clients who purchase land at Zuri Springs and who remit a ten percent (10%) deposit of the purchase price within five (5) days.
3.3 A voucher valued at KES 50,000 shall be awarded to each of the first five (5) clients who purchase land at Kijani Ridge and who remit a non-refundable booking fee of KES 200,000 within five days of receiving the Offer Letter.
3.4 A voucher valued at KES 30,000 shall be awarded to each of the first ten (10) clients who purchase a unit or units at Porini Point and who remit a non-refundable booking fee of KES 200,000 within five (5) days.
3.5 A voucher valued at KES 50,000 shall be awarded to each of the first ten (10) clients who purchase a unit or units at Jabali Towers and remit a non-refundable booking fee of KES 200,000 within five (5) days.
“Kijani Ridge”, “Oaklands”, “Zuri Springs”, “Jabali Towers”, and “Porini Point” shall collectively be referred to as products in plural and product in singular.
4. Voucher Collection and Redemption
4.1 Vouchers must be collected by 10 January 2026; failure to collect within the stipulated period shall result in automatic forfeiture.
4.2 Vouchers are personal to the qualifying client, non-transferable, and not redeemable for cash or any other consideration.
4.3 The Promoters shall not be liable for lost, stolen, misplaced, or destroyed vouchers, and no replacement shall be issued.
4.4 Each qualifying client shall be entitled to one voucher per eligible transaction only.
5. Booking Fee
5.1 Booking fees paid in respect of Jabali Towers, Porini Point, and Jabali Towers are strictly non-refundable under any circumstances.
5.2 Payment of the booking fee shall constitute conclusive acceptance of these Terms and Conditions.
6. Photography and Publicity
6.1 By participating in the Campaign, clients irrevocably consent to the Promoters capturing photographic, video, or other media records of voucher collection or related promotional activities.
6.2 The Promoters shall have the unrestricted right to use, reproduce, publish, and disseminate such media in any form and through any channel for marketing, advertising, or promotional purposes, without further approval or compensation.
7. Disclaimers and Limitation of Liability
7.1 The Promoters shall not be liable for:
7.1.1 Any indirect, incidental, or consequential loss arising from participation in the Campaign or use of vouchers;
7.1.2 Misuse, misapplication, or non-acceptance of vouchers by third parties;
7.1.3 Any failure or delay in performance occasioned by force majeure events, including but not limited to natural disasters, strikes, or governmental restrictions.
7.2 The Promoters makes no representation or warranty, express or implied, regarding the quality, merchantability, or fitness for purpose of goods or services obtained through voucher redemption.
8. General Provisions
8.1 The Promoters reserves the right to amend, suspend, or terminate the Campaign at its sole discretion, with or without prior notice once Upon allocation of vouchers to the qualifying clients as set out under Clause 3, and once the specified limits for each product have been reached, the corresponding product shall be withdrawn from the Campaign and shall no longer be available under its terms. Products whose voucher allocation limits have not been attained, the Campaign shall continue in respect of those products until the official end date of the Campaign, unless otherwise terminated earlier at the Promoters’ discretion.
8.2 All decisions of the Promoters regarding eligibility, voucher issuance, and interpretation of these Terms shall be final and binding.
8.3 Participation in the Campaign shall be deemed to constitute full and unconditional acceptance of these Terms and Conditions.
8.4 These Terms shall be governed by and construed in accordance with the laws of Kenya.
9. Severability
9.1 If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
9.2 The invalidity of any single clause shall not affect the validity of the remainder of these Terms.
10. Entire Agreement
10.1 These Terms and Conditions constitute the entire agreement between the Promoters and the participants with respect to the Campaign and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
10.2 No amendment, modification, or waiver of any provision herein shall be effective unless made in writing and duly authorized by the Promoters.
11. No Waiver
11.1 No failure, delay, or omission by the Promoters in enforcing any provision of these Terms and Conditions shall be construed as a waiver of its rights.
11.2 Any waiver granted by the Promoters must be expressly stated in writing and shall apply only to the specific instance for which it is given.
12. Governing Jurisdiction
12.1 Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions, the Campaign, or any voucher issued hereunder shall be subject to the exclusive jurisdiction of the courts of Kenya.
12.2 Participants expressly submit to the jurisdiction of such courts and waive any objection to proceedings therein on grounds of venue or forum non conveniens.
